Cosmetics: any article applied to the human body or any part for cleansing, beautifying, promoting attractiveness or altering appearance, expressly including personal hygiene products such as deodorant, shampoo and conditioner; excludes products regulated as drugs under 21 U.S.C. 321(g). No leave-on/rinse-off distinction. Leave-on and rinse-off products.

Same 25-substance list as Maryland (EU-derived). Prohibition has no 'knowingly' qualifier for manufacturers, but retailers that do not manufacture such cosmetics and do not knowingly sell them are exempt (§ 59.1-574.2(C)). Trace exemption for technically unavoidable quantities (impurity, manufacturing process, storage, migration from packaging) when made through a process intended to comply. Incidental ingredients excluded from 'ingredient'. Enforcement: violation is a prohibited practice under the Virginia Consumer Protection Act (§ 59.1-200(A)(88), § 59.1-574.3). The Article 1 civil penalty ($5,000 + $1,000/day, § 59.1-573) was narrowed by the same act to Article 1 (animal testing) only. No small-business exemption. HB 122 incorporated HB 864. Approved April 13, 2026.
