Stuffed toy registration and law labels: Pennsylvania, Ohio, Massachusetts (and the uniform label)

Who has to register, what it costs, and what the sewn-in law label must say, for stuffed toys sold in the three states that require it. Every statement below is followed by the words of the source it comes from, linked, with the date we checked it (October 4, 2026).

Which states

The association of state bedding and furniture labeling officials (IABFLO) names Pennsylvania, Ohio and Massachusetts as the main states that enforce stuffed-toy registration and law labels.

IABFLO suggests getting the Pennsylvania number first, because Pennsylvania accepts only its own number on the label.

Pennsylvania

Who registers: anyone who makes stuffed toys in Pennsylvania or imports them into Pennsylvania. The registration is with the Department of Labor & Industry (Division of Bedding and Upholstery).

“If you are in Pennsylvania and manufacture or import into Pennsylvania new, recycled, or a blend of new and recycled stuffed toys, you need to apply for a registration number with the State of Pennsylvania.”

A Pennsylvania store that only sells stuffed toys does not need a license of its own.

“If you're a store in Pennsylvania and you are only selling stuffed toys, you don't need a special license to sell them.”

What counts: any filled item meant for children's play. Pet toys are not covered.

How to apply: by mail on the Pennsylvania Toy Registration form, or online through the department's eDAP portal. Toy samples must be mailed either way.

What to send: a finished sample (not a prototype), a lab report showing the toy passes regulation sections 47.317, 47.321 and 47.322 (from a US-based lab or a CPSC-certified lab), and an affidavit from the person who pulled the sample.

Each factory needs its own number. Numbers cannot be shared or transferred between factories.

A registration lasts one year from the end of the month it is processed and must be renewed every year. The department says applications take about 30 days on average and cannot be expedited.

Recycled filling: Act 30 of 2024 (House Bill 1333) amended the Stuffed Toy Manufacturing Act. It was approved on June 28, 2024 and took effect 60 days later.

The label, under section 9.1(b) as added by Act 30, must carry three things: whether the material is new, recycled or a mix; the registration number preceded by "REG. NO. PA."; and a certification that the maker or importer does not use child labor, forced labor or slave labor.

The department's FAQ describes two label requirements (the material wording and the registration number) and does not mention the child-labor certification.

“For stuffed toy articles, a Pennsylvania Stuffed Toy law label has only two requirements. It must say "All New Material", “All Recycled Material”, or a “Blend of New and Recycled Material” and have your Pennsylvania Registration number from Stuffed Toy Regulation 47.315.”

The regulation the department posts (34 Pa. Code § 47.315, last amended in 1978) still says "all new material". The 2024 Act is newer.

Size: Pennsylvania sets no label size. The print just has to be legible.

Ohio

Who registers: anyone who imports, makes or wholesales stuffed toys for sale in Ohio. The registration is with the superintendent of industrial compliance (Ohio Department of Commerce).

Hobby exemption: a person not regularly in the business who makes stuffed toys as a leisure pursuit and sells 100 or fewer a calendar year does not register. Each toy still needs a label with the maker's name and address, a statement that the maker is not registered by Ohio, and a statement that the contents have not been inspected.

Another state's number: the Ohio application has a box to ask Ohio to recognize it. You still apply in Ohio and send a copy of the other state's current license.

Label: the maker's registered name and address, or the registration number (the rule says this is the same number the maker holds in any other state where it is registered), and "All new material" with the types of filling.

Per-item fee: Ohio also charges a per-item fee, paid with a report of items brought into or made for Ohio. It is quoted here as written; we do not calculate it. The Commerce Department page calls it semiannual, while the statute says the report is filed once a year.

Each report shall be accompanied by a fee of four cents for each item of bedding or stuffed toy imported into this state or manufactured in this state.”

Massachusetts

Who licenses: the Department of Public Health's Division of Food Protection. Makers of stuffed toys need a manufacturer's license every year, and out-of-state makers who ship into Massachusetts need one first.

New material only: the Massachusetts definition of a stuffed toy says all materials must be new.

Size: the general minimum label size is 2 by 3 inches, but a stuffed-toy label may be smaller if it is legible.

“The minimum size of the label shall not be less than two inches by three inches, but may be larger as need demands. A label on a stuffed toy may be smaller than two inches by three inches, provided that the information on the label is clearly legible and in sufficient size type, so that it can be readily discerned.”

Other states' numbers: the statute lets the department permit reciprocity by regulation. The label rule names the name and address or the Massachusetts license number.

Does the Pennsylvania number work in Ohio and Massachusetts?

Ohio: yes, if you ask for it on the Ohio application. You still register in Ohio (see Ohio above).

Massachusetts: IABFLO's 2018 guide says Massachusetts accepts the PA number. The Massachusetts license is still required, and the Massachusetts rule also allows the name and address on the label (see Massachusetts above).

Minimum size: none for toy labels. The form, design and size are the maker's choice if the label is legible. You may print on both sides, and filling percentages are not required.

Ohio's sample toy label says the same about size and percentages, and names the label material: white vellum cloth, Tyvek or similar.

Loose fillers such as pellets, beads, sand or rice must be inner-bagged and listed, and stiffeners must be listed. Rattles, squeakers, music boxes and electronic parts do not need to be listed.

Corrections to older charts

Texas no longer regulates bedding or issues registration numbers. Senate Bill 202 (2015) repealed the bedding chapter of the Health and Safety Code, effective September 1, 2015.

The Toy Association's "Stuffed Toy Licensing and Labeling Laws" summary (PDF created May 2017; its original link now returns an error, so we link an archived copy) was a clear three-state summary in its time. Some of it has since changed: it gives Pennsylvania's fee as $25, now $96.84 (see above), and it predates Pennsylvania's 2024 Act on recycled material and the child-labor certification.
